MEANING OF PERSONAL INFORMATION

"Personal information" means information relating to an identified or identifiable individual or household.  This information may include, but is not limited to, your name, date of birth, mailing address, e-mail address and telephone number.

PERSONAL INFORMATION - WHAT WE COLLECT FROM YOU

We do not collect any personal information from you unless you provide it to us in one of the ways discussed in this Policy. The personal information we collect generally includes one or more of the following categories: identifiers, contact information, demographic information (such as gender and age), payment card information associated with you, commercial information, Internet or other electronic network activity or device information, geolocation data, audio, electronic, visual or similar information, and inferences drawn from the above.

HOW WE COLLECT PERSONAL INFORMATION

For individuals who visit our website(s) located at www.smartsweets.com (collectively, “our websites”), we may collect information from you or from your activities on the websites, such as the following:

  • When you sign up for the newsletter, we collect your email address;
  • When you register, create, and populate your account, we may collect your name, month and day of birth, email address, password, contact and billing information, and we may thereafter personalize your experience on our websites when you are logged in to your account.
  • When you place an order on our online store or access your account through our website, we collect information necessary to process your order, including your name, contact information, billing address, shipping address and items ordered. We do not collect payment card information.  If you make an online payment using a payment card, such as a credit card or debit card, you are connected directly to our online payment processing service providers and your payment card information is collected and processed by that service providers.   • When you apply for a job, we may collect your email address, your name, surname, resume and any other information you may provide us.
  • When you apply to be an influencer, we may collect your email address, your name, your mailing address, your date of birth, and your social media profiles.
  • Like most websites and other Internet services, we may collect certain technical and device information about your use of our website. Such information may include your Internet protocol address (“IP address”), information about your device (e.g. model or operating system), browser and operating system, and the date and time of your visit.  We may also collect or infer your geographic location based on your IP address.
  • We may also use “cookies” and similar technologies, or we may enlist third party services which use cookies and similar technologies to track your preferences and activities on our websites. Cookies are small data files transferred to your computer’s hard-drive by a website, if your browser is enabled to accept cookies.  They keep a record of your preferences, making your subsequent visits to the site more efficient. For individuals who otherwise interact with us, whether in person, by phone or email, through social media or otherwise, including individuals who might be interested in acquiring our products or services, who sign-up to receive newsletters or other communications, who leave online reviews or submit feedback, who request refunds, or who respond to surveys and questionnaires, we may collect information that you provide to us during these interactions. This information may include your name, profile photo, or other information included in your profile, e-mail address and other contact information.  We may also record customer calls to our customer service representatives.

WHAT NON-PERSONAL INFORMATION WE COLLECT FROM YOU

General, aggregated, demographic, and non-personal information may be collected by us through our websites, but any such information will not be linked to any of your personal information. This type of anonymous, aggregated profiling and session data may include information that you have provided to us through surveys, polls, etc., and may also include aggregated anonymous information about website usage and the customer base.  In many cases, we will automatically collect certain non-personal information about your use of the website(s), including but not limited to information concerning the type of internet browser or computer operating system you are using, the domain name of your internet service provider, your “click path” through our website, and the website or advertisement that was linked to or from the websites when you visited. As explained elsewhere in this Policy, personal information we collect may be processed by our partners in providing services related to our websites or otherwise offering our products and services (such as administration services, technical services relating to the maintenance, servicing, and upgrading of software, hosting services, customer service, data migration services, and analytical services, among others).

 

HOW WE SHARE YOUR PERSONAL INFORMATION

We rely on third party services providers to perform a variety of services on our behalf, such as e-commerce providers, payment card processers, telephone and technical support providers, hosting, data storage and processing service providers, marketing and advertising providers and customers, and research and analytics providers.

In some circumstances, we may permit our service providers to retain aggregated, anonymized or statistical information that does not identify you.  We do not authorize the service providers to disclose your personal information to unauthorized parties or to use your personal information for their direct marketing purposes. Reviews submitted on the website are intended for public display and are therefore viewable by members of the public, including your first name and last initial, as well as photo content you supply as part of your account or review. That review and any personal information associated with the review may be shared with our syndication partners, and the review may be displayed on other social media or third-party marketplaces.

Additionally, we may use and disclose your information to various lawful recipients, such as when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our products and services; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

CHOICES REGARDING YOUR PERSONAL INFORMATION

Opting-Out of Communications.  If you no longer want to receive marketing-related emails from us, you may opt-out of receiving marketing-related emails by clicking the “unsubscribe” link at the bottom of any email you receive from us.  You may also opt-out by contacting us directly using the contact information in the “Contact Us” section below.

We will endeavour to respond to your opt-out request promptly, but we ask that you please allow us a reasonable time to process your request.  Please note that if you opt-out from receiving marketing-related emails, we may still need to send you communications about your use of our products, or other matters.

Do-Not-Track: Our website does not respond to your browser’s do-not-track request. If you do not want information collected through the use of cookies, you can manage/deny cookies (and certain technologies) using your browser’s settings menu. You must opt out of third party services directly via the third party. Please see the section below on Third Party Websites and Services for further information.

Advertising: You may opt out or withdraw your consent to behavioral advertising. In some cases, we may be able to process third party opt-out requests directly, however in some cases, you must opt out of third party services directly via the third party. We make reasonable efforts to ensure that your personal information is kept as accurate, complete and up-to-date as reasonably necessary.  We will not routinely update your personal information, unless such a process is necessary, and provided that we have the updated information.  We expect you, from time to time, to supply us with updates to your personal information, when required.

 

INTERNATIONAL TRANSFER AND STORAGE

Your personal information may be stored and processed in any country where we have facilities or in which we engage third party service providers. This Policy applies only to our websites and products.  It does not extend to any websites, products, social media platforms or services provided by third parties. 

As outlined above, we rely on third party services providers to perform a variety of services on our behalf in connection with our websites, services and products, such as e-commerce providers, payment card processers, telephone and technical support providers, hosting, data storage and processing service providers, and research and analytics providers.

There may be times where a third party may ask to collect your personal information themselves. These third parties can include advertisers and third party service providers and payment processors. When you provide your personal information to such third parties, they will use your personal information in accordance with their own privacy policies and not this Policy. Therefore, you should read their privacy policies carefully before providing them with your personal information. If you leave a review on our website, that review and personal information associated may be shared and displayed publicly on other third party websites.   • Social Login by OxiApps. We use this to facilitate single sign-on for our online store users with their social media accounts. When you use social login, we may disclose information related to your device, the websites you visit, the advertisements you view, and information regarding your activities on our website.   • Facebook Pixel. We use the Facebook Pixel to analyze user activity on our websites for remarketing and behavioral targeting. When users complete an action we define, such as purchasing a product, Google’s system recognizes the cookie through a conversion tracking tag, or code snippet, that we placed on the Website, and Google records a conversion.   • Storepoint provides store locator and geolocation functions, in reliance on Google Maps.   • TikTok Pixel. We use the TikTok Pixel to analyze user activity on our websites for remarketing and behavioral targeting. CHILDREN’S INFORMATION

Our website is not intended for children under the age of 16 and we do not knowingly collect personal information from children under that age.   • Right to Delete: You have the right to delete certain personal information that we hold about you, subject to exceptions under applicable law.

 

  • Right to Non-Discrimination: You have the right to not to receive discriminatory treatment as a result of your exercise of rights conferred by the CCPA.

 

  • Direct Marketing: You may request a list of personal information we have disclosed about you to third parties for direct marketing purposes during the preceding calendar year.

 

  • Opt-Out of Sale: We may engaged in the “sale” of data (as defined by the CCPA.  You may direct us to stop selling your data to third parties by completing our “do not sell form” here.

 

  • Minors: To the extent we have actual knowledge that we collect or maintain personal information of a minor under age 16, those minors between the age of 13 and 16 must opt in to any sales of personal information (as defined under CCPA), and minors under the age of 13 must have a parent consent to sales of personal information (as defined under CCPA); all minors have the right to opt-out later at any time. 

 

  • Minors’ Online Posts: Individuals under the age of 18 in California can delete or remove posts by sending an email to privacy@smartsweets.com. We will work to delete your information, but we cannot guarantee comprehensive removal of that content or information beyond our website.

 

Verification of Requests

If you submit a data rights request to us, we may take steps to verify your identity in order to ensure that the individual making the request is authorized to make that request, to reduce fraud, and to ensure the security of your Personal Data.  We may require that you provide the email address we have on file for you (and verify that you can access that email account) as well as an address, phone number, or other data we have on file, in order to verify your identity. If an agent is submitting the request on your behalf, we reserve the right to validate the agent’s authority to act on your behalf.
